Active Family Building Legislation

Vermont unfortunately does not have a Fertility Insurance Law…YET.

UPDATE March 2024: Unfortunately, this fertility insurance legislation did not make it past “Crossover”, which is the deadline for bills to clear at least one committee in one chamber of the Vermont Legislature. So, the legislation will not advance this session. We will not give up and are not done fighting or raising awareness about this.

Thank you to everyone for your continued advocacy and commitment!

An act relating to health insurance and Medicaid coverage for fertility-related services (H.369)

An act relating to health insurance and Medicaid coverage for fertility-related services (S.63)

Lead Sponsor: Sen. Ruth Hardy
Co-sponsors: Sens. Virginia Lyons, Andrew Perchlik, Kesha Ram Hinsdale, Tanya Vyhovsky, Anne Watson, and Rebecca White

Without insurance coverage, most Vermont residents do not have access to fertility care. The majority of Vermonters do not have fertility coverage and Insurance companies seem to regard fertility services as elective or not “medically necessary”. As a result, most households seeking fertility treatments must pay out-of-pocket to cover the medical expenses, which is impossible for many. This legislation would enhance access to fertility treatment by requiring in-state private insurance and Medicaid plans to provide coverage for fertility services, thereby bridging the gap in access to care.
