Active Family Building Legislation
A bill to prohibit the limitation of access to assisted reproductive technology, and all medical care surrounding such technology (S.3612/H.R.7056)

S.3612/H.R.7056, known as the Access to Family Building Act of 2024, was introduced in January. This legislation would establish a statutory right to access assisted reproductive technology (ART), including IVF. This will ensure that ART services remain legal and available everywhere in the United States. This is particularly critical in the current national context, where the future of fertility care is vulnerable to anti-abortion attacks across the country.
The Access to Family Building Act will:
- Establish a statutory right for an individual to access, without prohibition or unreasonable interference, ART services, such as IVF, and for a healthcare provider to provide ART services;
- Establish an individual’s right regarding the use or disposition of their reproductive genetic materials, including gametes;
- Allow the Department of Justice to pursue civil action against any state, government official, individual or entity that violates protections in the legislation; and
- Create a private right of action for individuals and healthcare providers in states that have limited access to ART.

This crucial legislation will keep access to fertility treatment legal and available everywhere in the United States. One in 6 people has infertility, and some may need fertility care such as IVF to grow their family.
Unfortunately, many states have introduced legislation that would restrict or prohibit access to IVF, a medical treatment that results in 2% of all births in the nation. I want to ensure that every American, regardless of where they live, has access to the medical care they need to try to build their family. The Access to Family Building Act of 2024 would establish a statutory right to access assisted reproductive technology (ART) such as IVF. This will ensure that ART services remain legal and available everywhere in the United States.
